If there's one thing that'd motivate people to lose weight, it'd be by luring them to do it using money, or in this case savings. I'm not a lawyer, but I doubt that ACLU would want to pick up the case because of that.
No, it's not quite "fair". But it's not unreasonable, either. In a very broad sense, the university wants to make you as ready for the world as they can, and in fact, the quotes I read about why they made this policy was very much along those lines. If as a graduate of the school you are a failure in life, that can actually reflect quite poorly on the school, so there's a feedback loop at work. I can't really think of anything outside the traditional protected classes that I can come up with a policy for that would be a problem, in my eyes. If the school became too annoying for people to deal with, they would go to other schools, and no university would ostracize so many students that they go out of business. I think Kat just won the case for the people against the BMI requirement if they took it to court. A school wants to make you healthy by putting a requirement and they serve pepsi and kfc...

Amusement parks have the weight limits to ride, even though its for mechanical reasons but not like other places can't do it. And no, I don't attend Lincoln University, I like digging up dirt. It seems a tad bit hyprocritcal that their entire campus is promoting unhealthy eating habits, yet they require you to be under a certain BMI to graduate. Especially since, like most college dorms, they don't allow cookware of any kind.

Sounds more like liability issues. As a graduate you're liable to influence the rep of the school through your knowledge and physical stature. Cookware?!?!? George Foreman doesn't start fires! But then again, so long as it's a private establishment, their rules (within limits, obviously.) Perhaps instituting some sort of bonus or premium item or service for those who meet said requirements? Slightly off-topic, but some of you might find this interesting. A few semesters ago I was supposed to be a personal trainer (I left the program because they wanted me to be training athletes and I wanted to train normal people.) Anyways, in one of my classes the professor told us that they are starting to see the warning signs of strokes and heart attacks in young children who are obese, because children are becoming more obese at a younger age. I wish the professor had said where he got his data, I would have liked to look it up for myself.
But anyways, back on-topic. A phys. ed course is a good thing, but my personal opinion is that colleges shouldn't discriminate. If they want to require some people to take a phys. ed course, they should make them all take it. But on the other hand, did I read somewhere that this was a private school? Private schools seem to have looser regulations on discrimination. And isn't some form of Phys Ed required for most liberal arts majors? Hell, I studied Music and I had to take a form of phys ed. (yay for swimming) Hey thanks for reminding me. How do they go about figuring someone's BMI? 6'4" and 250 says you're fat based on the internet calculators, but if you're footballer than that's 250lbs of muscle.
I doubt they have the time to give all the students the water displacement measurement even though that's the most accurate way to measure.
